- The Service is strictly for business-to-business purposes and is intended for licensed contractors and service providers. Homeowners and individual consumers are prohibited from creating accounts.
2. Account Registration and Security
- To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.
- You agree to notify Leadcheck immediately if you suspect unauthorized access or any other breach of security.
3. Use of the Service
- Purpose: The Service enables contractors to enter and view reviews about their clients (homeowners) and access insights on leads they have independently obtained.
- Data Entry: By entering a homeowner's information (e.g., first name, last name, address, email, and phone number) into the Service, you represent that you have obtained this information independently and have a legitimate business reason for including it in the Service.
4. User-Generated Content and Reviews
- You are solely responsible for any information or reviews you submit to the Service. By submitting content, you grant Leadcheck a limited license to store, process, and display the content solely within the context of the Service.
- Content Visibility: Reviews and homeowner information are visible only to the contractor who submitted them, unless another contractor has also independently obtained and added the same lead to their own list.
- Accuracy and Legality: You represent that the content you submit is accurate, lawful, and does not infringe the rights of any third parties.
5. Privacy Compliance
- Leadcheck is committed to protecting the privacy of all user and client data in compliance with applicable federal and state privacy laws, including those governing consumer rights to access, delete, and control personal information. By using Leadcheck, you agree that our data collection, processing, and retention practices align with relevant privacy regulations in the United States. If you are a resident of a state with specific privacy laws (such as California, Virginia, Colorado, Connecticut, Utah, or others), you may have additional rights regarding your personal information. 6. Data Handling and Access Control
- Leadcheck does not share or sell homeowner information to any third parties. Data submitted to the Service is used exclusively to provide Service functionality.
- Access Restriction: Only contractors who have independently acquired the same homeowner information can view associated reviews.
- Anonymization (If Applicable): As a contingency, Leadcheck may implement anonymization techniques, in which case identifiable client information will be encrypted or pseudonymized on our servers while still allowing contractors to view relevant insights.
7. Compliance with Privacy Laws
- Data Responsibility: By using the Service, you agree to comply with all applicable privacy and data protection laws in relation to the information you submit, including but not limited to the California Consumer Privacy Act (CCPA) where applicable.
- CCPA Exemption: Leadcheck operates as a business-to-business platform and does not permit homeowners to create accounts or view data within the Service. We collect and store information solely for business purposes, limiting access to only the contractors who independently obtain client information.
8. Limitations of Liability
- Free Speech: You acknowledge that Leadcheck facilitates contractor reviews and opinions as a legitimate business purpose and free speech activity.
- Data Requests: Leadcheck reserves the right to retain or deny deletion requests for reviews or content that serve our business purposes and align with free speech protections, unless legally required to delete such content.
- Limited Liability: Leadcheck is not liable for any content submitted by users or the accuracy of reviews. We are not responsible for any damages arising from use or misuse of the Service.
9. Data Security
- Leadcheck employs industry-standard security measures to protect data submitted to the Service. However, no transmission over the internet is completely secure, and we cannot guarantee absolute security.
10. Modification and Termination of Service
- Leadcheck reserves the right to modify, suspend, or discontinue the Service at any time, with or without notice. We may also update these Terms, and your continued use of the Service signifies acceptance of any changes.
11. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the State of California without regard to its conflict of law principles. Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in California.
